ഇക്വഡോറിലെ ജനങ്ങളും എണ്ണ ഭീമന് ഷെവ്രോണും(Chevron) തമ്മിലുള്ള 17 വര്ങ്ങളായി തുടരുന്ന കേസില് എണ്ണ ഭീമന് തെളിവുകള് നശിപ്പിച്ചു എന്ന് വാദികള് ആരോപിക്കുന്നു.
Petroecuador എന്ന പൊതുമേഖലാ കമ്പനിയുമായി കൂടിച്ചേര്ന്ന് 1964 – 1992 കാലത്ത് Texaco എണ്ണക്കായി ഇക്വഡോറില് ഖനനം നടത്തി. 2001 ല് ടെക്സാകോയെ ഷെവ്രോണ് വാങ്ങി.
എണ്ണ ഉത്പാദനത്തിന്റെ ബാക്കിവെന്ന 5400 കോടി ലിറ്ററില് കൂടുതല് വിഷ മാലിന്യങ്ങള് മഴക്കാടുകളിലെ കുഴികളില് ടെക്സക്കോ മനപ്പൂര്വ്വം ഒഴുക്കി എന്നതാണ് കേസ്.
തനിക്ക് പണം തന്നില്ലെങ്കില് കമ്പനി കൃത്രിമത്തം കാട്ടിയ “നിര്മ്മിച്ച” തെളിവുകള് പുറത്തുവിടും എന്ന് ഷെവ്രോണ് കരാറുകാരന് Diego Borja കമ്പനിയെ ഭീഷണിപ്പെടുത്തുന്നത് രഹസ്യമായി റിക്കോഡ് ചെയ്ത സംഭാഷണങ്ങളിലുണ്ട്.
Borja ന്റെ ഒരു ബാല്യകാല സുഹൃത്തായ Santiago Escobar ആണ് അത് റിക്കോര്ഡ് ചെയ്ത വ്യക്തി. “ഷെവ്രോണിനെ സഹായിക്കാനായി സാമ്പിളുകളുടെ ടെസ്റ്റിങ്ങില് താന് എന്ത് ചെയ്യുന്നു എന്ന് Diego എല്ലായ്പ്പോഴും ഞങ്ങളോട് പൊങ്ങച്ചം പറയാറുണ്ട്,” എന്ന് അയാള് പറഞ്ഞു.

ഒരു സമയത്ത് കമ്പനിക്ക് വേണ്ടി സാക്ഷിയായി കോടതിയിലെത്തിയ Borja ചിരിച്ചുകൊണ്ട് പറഞ്ഞു, “കുറ്റകൃത്യം പണം തരും.”
Borja ന്റെ ആറ് മണിക്കൂര് വീഡിയോ ടേപ്പും, 25 പേജ് ചാറ്റ് മെസേജുകളും വാദികളുടെ വക്കീല് പുറത്തുവിട്ടു. അതിലെ വിവരങ്ങള്:
• Chevron had “cooked” the evidence and, if the U.S. judge who sent the case to Ecuador in the first place ever knew, he would “close [Chevron] down.”
• If Chevron “tricked” him he would “immediately go to the other side… I have correspondence that talks about things you cannot even imagine, dude… I can’t talk about them here, dude, because I’m afraid, but they’re things that can make the [plaintiffs] win this just like that” at which point he snapped his fingers.
• The energy giant used him to set up four dummy companies to make them appear to be independent of Chevron, but in fact they were controlled by Chevron.
• The supposed “independent” laboratory that processed soil and water samples for Chevron to submit as evidence in the trial was not “independent” at all. “I have proof that they [the laboratories] were more than connected, they belonged to [Chevron],” said Borja, who also indicated he signed the contract to rent the house where Chevron’s laboratory was located.
• Borja conceded there was no bribe of the Ecuador trial judge, Juan Nunez, in the videotapes — confirming the long held contention of the plaintiffs and contradicting Chevron’s assertions. With the videotapes, Borja said he did in “two days” what Chevron had been trying to do for a year, which was to get the judge dismissed.
Borja ന്റെ ഭാര്യ Sara Portilla ഷെവ്രോണില് നാല് വര്ഷം Severn Trent Labs (STL) ന്റെ പ്രതിനിധിയായി ജോലി ചെയ്തിരുന്നു. ആ കമ്പനിയാണ് മലിനീകൃതമായ സാമ്പിളുകള് പരിശോധിച്ച “സ്വതന്ത്ര” ലാബ്.
ഷെവ്രോണിന്റെ ആസ്ഥാനത്തിനടുത്തുള്ള ഒരു വീട്ടില് മാസം $6,000 ഡോളര് വീതം വാടക കൊടുത്ത് Borja നെ പാര്പ്പിച്ചിരുന്നു. ശമ്പളമായി $10,000 ഡോളറും നല്കുന്നു.
